Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Heartocast web application, including any related services and features (collectively, the "Service"). The Service is operated by us, the individual developer of Heartocast ("we", "us", or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

1.1. By accessing, browsing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.

1.2. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation, and the references to "you" in these Terms apply to both you and that organisation.

1.3. We may update these Terms from time to time in accordance with Section 15. Your continued use of the Service after any change constitutes acceptance of the revised Terms.

2. Description of the Service

2.1. Heartocast is an unofficial, fan-made, free weather forecast and cooking/crop timer app for the game Heartopia.

2.2. The weather forecast is calculated on your device, and using the Service requires no account, no login, and no payment. The Service is provided free of charge.

2.3. The Service is not an official Heartopia product. "Heartopia" and all related names, characters, and assets are the property of their respective owners. Heartocast is a non-commercial fan tool, provided for personal, informational use only. See Section 7 for the full fan-tool disclaimer.

2.4. The Service is available at https://hearto.ixtj.dev.

3. Eligibility

3.1. By using the Service, you represent that you are legally able to form a binding contract under the laws of your jurisdiction (for example, that you are at least 18 years of age, or have the consent of a parent or legal guardian where required).

3.2. The Service is not directed at children under 13 years of age, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us on Discord (shanefully_done) so we can take appropriate action.

4. Accounts

4.1. No account or registration is required or offered. The Service does not provide user accounts, logins, or any form of registration.

4.2. You may use all features of the Service without creating an account or providing any contact details to us.

5. Acceptable Use

5.1. You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of the Service by, any other person.

5.2. You agree not to:

• (a) use the Service for any unlawful, fraudulent, harmful, or abusive purpose;
• (b) attempt to overload, crash, or disrupt the Service, its servers, or its infrastructure, including through automated scraping, bots, or excessive requests;
• (c) reverse-engineer, extract, republish, or redistribute the underlying forecast data, source code, or content of the Service beyond the personal, non-commercial use the Service is designed for;
• (d) introduce viruses, malware, or any other malicious code to the Service; or
• (e) misrepresent the Service as official, or claim any affiliation with, or endorsement by, the developers or owners of Heartopia.

5.3. You must respect the intellectual property rights of third parties, including the owners of Heartopia and any other rights holders referenced by the Service. See Section 7.

6. User-Generated and Local Data

6.1. The Service allows you to create and save your own cooking and crop timer presets and to subscribe to weather notifications. This data — including your saved timer presets, alarm volume setting, and notification subscriptions — is stored only in your own browser and is never submitted to, transmitted to, or stored by us.

6.2. Because this data resides solely on your device, you are responsible for managing and backing it up. Clearing your browser's site data will remove your saved presets, volume setting, and notification subscriptions.

7. Intellectual Property & Fan-Tool Disclaimer

7.1. The Heartocast source code, design, layout, and original content (other than third-party game names and assets) are owned by us and protected by applicable intellectual property laws.

7.2. Fan-tool disclaimer. Heartocast is an unofficial, fan-made project. "Heartopia" and all associated names, characters, artwork, and other game assets are the property of their respective owners. Heartocast is not endorsed by, sponsored by, or affiliated with the developers or publishers of Heartopia.

7.3. Heartocast is provided on a non-commercial basis. The extracted weather data was obtained for personal, non-commercial use as a fan tool, and is not for resale or commercial redistribution.

7.4. If you are a rights holder and believe that any content on the Service infringes your intellectual property, please contact us on Discord (shanefully_done) with the details of your concern.

8. Third-Party Links and Credits

8.1. The Service may contain links to third-party websites, data sources, or resources, and may rely on third-party libraries and credits. These are provided for convenience and acknowledgement only.

8.2. We have no control over, and accept no responsibility for, the content, practices, or availability of any third-party websites or services. Your use of any third-party website is at your own risk and subject to that third party's terms and policies.

8.3. Where we display credits for data sources or third-party libraries, such acknowledgement does not imply any endorsement by those parties of Heartocast or us.

9. Analytics

9.1. We use a privacy-friendly, cookieless analytics service to understand how the Service is used in aggregate. Our analytics uses no cookies, performs no browser fingerprinting, does not track you across websites, and collects no personally identifiable information; only aggregated, anonymized usage data is recorded.

10. Service Availability and Changes

10.1. The Service is provided free of charge and "as available". We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

10.2. We may modify, suspend, discontinue, or restrict access to the Service, or any part of it, at any time and without notice or liability.

10.3. We may add or remove features as we continue to develop the Service. Changes to the underlying game after our data was obtained may affect forecast accuracy, for which we accept no responsibility.

11. No Warranty

11.1. The Service is provided "as is" and "as available", with all faults and without warranty of any kind.

11.2. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

11.3. We do not warrant that the Service will meet your requirements, that the weather forecasts or timers will be accurate or complete, or that the Service will be free of errors or interruptions.

12. Limitation of Liability

12.1. To the maximum extent permitted by law, in no event shall we, or our officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of, or inability to use, the Service.

12.2. Because the Service is provided free of charge, our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the maximum extent permitted by law and, where possible, to the amount you have paid us for the Service (which is zero).

12.3. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

13. Indemnity

13.1. To the maximum extent permitted by law, you agree to indemnify and hold harmless us, and our officers, employees, and affiliates from any claim, demand, loss, damages, or expense (including reasonable legal costs) arising out of your breach of these Terms or your misuse of the Service.

14. Termination

14.1. You may stop using the Service at any time, for any reason. Because no account is required, simply discontinuing use is sufficient.

14.2. We may restrict, suspend, or block your access to the Service at any time if we believe you have breached these Terms, where required by law, or to protect the Service or other users.

14.3. Upon termination, the provisions of these Terms which by their nature should survive — including Sections 7, 11, 12, and 13 — will continue to apply.

15. Changes to These Terms

15.1. We may revise these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document.

15.2. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the Service.

16. Governing Law and Jurisdiction

16.1. These Terms, and any dispute arising out of or relating to the Service, are governed by the laws of Australia (New South Wales).

16.2. Subject to any non-excludable consumer rights, you submit to the exclusive jurisdiction of the courts of New South Wales, Australia, and we both agree to the exclusive jurisdiction of those courts.
